These Terms of Service ('Terms') govern access to and use of the AchievoEDU platform, including the web application available at achievoedu.com.au and associated iOS and Android mobile applications (collectively, the 'Platform'), provided by AchievoEDU PTY LTD ('AchievoEDU').
By registering a school account or using the Platform, the subscribing school ('School', 'you') agrees to be bound by these Terms. If you do not agree, do not use the Platform.
1. The Platform
AchievoEDU provides a cloud-based school rewards and behaviour management platform. Features include but are not limited to: student points and rewards, badge systems, house competitions, character progression tracking, mentorship tools, word of the day, store and fulfilment management, attendance integration, analytics and reporting, and parent visibility portals.
Features are subject to change. AchievoEDU will provide 30 days' notice of any material reduction in features included in a School's current subscription tier.
2. Account Registration and School Responsibilities
- The School is responsible for ensuring all staff and student accounts are created and managed appropriately
- The School must designate at least one School Administrator who is responsible for the account
- The School must ensure that all users are informed of their rights under the Platform's Privacy Policy
- The School is responsible for the accuracy of student and staff data entered into the Platform
- Account credentials must not be shared between users
- The School must notify AchievoEDU promptly of any suspected unauthorised access
3. Subscription and Payment
3.1 Subscription Tiers
AchievoEDU offers the following subscription tiers (current pricing available at achievoedu.com.au/contact):
- Essential — up to 500 students
- Plus — up to 1,200 students
- Pro — up to 2,500 students
- Custom — unlimited student seats, tailored pricing and features
3.2 Payment Terms
- Subscriptions are billed annually in advance in Australian Dollars (AUD) inclusive of GST
- Payment is due within 30 days of invoice date
- Overdue accounts may have Platform access suspended after 14 days written notice
- Prices may be adjusted annually with 60 days' written notice
3.3 Refunds and Cancellation
- Cancellation requests must be submitted in writing to billing@achievoedu.com.au
- Schools may cancel within 30 days of initial subscription for a full refund
- After 30 days, refunds are calculated on a pro-rata basis for unused complete months
- One-time fees (onboarding, training) are non-refundable once services have been delivered
4. Acceptable Use
The Platform must not be used to:
- Collect or store information about students beyond what is necessary for educational purposes
- Bully, harass, or demean any student or staff member
- Attempt to access data belonging to other schools
- Reverse-engineer, copy, or reproduce any part of the Platform
- Upload malicious code, viruses, or any harmful content
- Use the Platform for any commercial purpose other than internal school administration
AchievoEDU reserves the right to suspend accounts found to be in breach of this section without notice.
5. Data Ownership and Privacy
- All student and school data uploaded to the Platform remains the property of the School
- AchievoEDU acts as a data processor on behalf of the School as the data controller
- Data handling is governed by the AchievoEDU Privacy Policy and, for schools requiring it, the Data Processing Agreement
- Upon termination, the School may request a full data export within 60 days of account closure
- All School data will be permanently deleted within 90 days of account closure
6. Intellectual Property
- All Platform software, design, content, and branding is the intellectual property of AchievoEDU PTY LTD
- Schools are granted a non-exclusive, non-transferable licence to use the Platform for internal educational purposes
- Schools may not sublicence, sell, or transfer access to the Platform to any third party
- Custom content created by schools within the Platform (e.g. custom badges, store items) remains the property of the School
7. Service Availability and Support
- AchievoEDU targets 99.5% platform uptime, excluding scheduled maintenance windows
- Scheduled maintenance is communicated at least 48 hours in advance and performed outside school hours (AEST) where possible
- Support is available via support@achievoedu.com.au during business hours (Mon–Fri, 8am–5pm AEST)
- Response times vary by subscription tier — see the Service Level Agreement for details
8. Limitation of Liability
To the maximum extent permitted by Australian law:
- AchievoEDU's total liability to a School in any 12-month period is limited to the subscription fees paid by that School in that period
- AchievoEDU is not liable for indirect, consequential, or incidental loss including lost data, lost revenue, or reputational harm
- AchievoEDU is not liable for outages or data loss caused by third-party infrastructure providers (including Microsoft Azure)
- Nothing in these Terms limits liability for death, personal injury, or fraud
9. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland. AchievoEDU is committed to resolving disputes in good faith before resorting to formal proceedings.
10. Amendments
AchievoEDU may amend these Terms with 30 days' written notice to the School Administrator's registered email address. Continued use of the Platform after the notice period constitutes acceptance. Schools who do not agree to the amendments may terminate their subscription and receive a pro-rata refund for the unused period.
